These Terms of Service (the “Terms”) govern your access to and use of the eCSyn application, websites and related services (together, the “Service”) provided by ECONNECION SDN. BHD. (Registration No. 202401005594), a company incorporated in Malaysia (“eConnection”, “we”, “us” or “our”).
By creating an account, or by accessing or using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation, and “you” refers to that organisation. If you do not agree, do not use the Service.
You must be at least 18 years old and capable of forming a binding contract to use the Service. You are responsible for the information you provide, for keeping your login credentials confidential, and for all activity that occurs under your Account. Notify us immediately at support@ecsyn.com if you suspect unauthorised use.
Team plans let you invite users into a shared Workspace with roles (for example owner, manager and member). The Workspace owner is responsible for its users, for their compliance with these Terms, and for the Customer Data they add. Seat and usage limits depend on your Plan.
Paid Plans are billed in advance on a recurring basis (monthly or annually) at the prices shown on our pricing page. By subscribing, you authorise us and our payment processor to charge your payment method for each billing cycle until you cancel. Fees are exclusive of taxes unless stated; you are responsible for applicable taxes.
Cancellation, downgrades and refunds are governed by our Refund & Cancellation Policy. We may change prices or Plan features on reasonable notice; changes take effect at your next renewal.
We may offer a Free Plan or trial with limited capacity. Free and trial usage is provided “as is”, may be changed or withdrawn at any time, and is subject to the usage limits stated at sign-up.
Your use of the Service must comply with our Acceptable Use Policy, which is incorporated into these Terms. Any breach of that policy is a breach of these Terms.
As between you and us, you own your Customer Data. You grant us a worldwide, non-exclusive licence to host, process, transmit and display Customer Data solely to provide and improve the Service and as permitted by our Privacy Policy and, where applicable, our Data Processing Addendum.
Contacts and business cards. The Service lets you capture other people’s personal data (for example by scanning a business card, importing a CSV or adding a connection). You are responsible for ensuring you have a lawful basis and any required consent to collect, upload and process that personal data, and for handling it in line with applicable data-protection law. You must not upload data you are not entitled to use.
The Service, including its software, design, branding and content (excluding Customer Data), is owned by eConnection and its licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms. You may not copy, modify, reverse-engineer, resell or create derivative works from the Service except as permitted by law.
The Service integrates with or relies on third-party services (for example messaging, email delivery, hosting and payment providers). Your use of those integrations may be subject to the third party’s own terms, and we are not responsible for third-party services. Messaging features (such as WhatsApp and email) must be used in compliance with the relevant provider’s policies and anti-spam laws.
We aim to keep the Service available but do not guarantee uninterrupted or error-free operation. We may modify, suspend or discontinue features, and perform maintenance, from time to time. We may also update the Service to improve security and functionality.
You may stop using the Service and cancel at any time. We may suspend or terminate your access if you breach these Terms, fail to pay fees, or use the Service in a way that risks harm to us, other users or third parties. On termination, your right to use the Service ceases. We will handle your Customer Data on termination as described in our Privacy Policy and DPA.
To the maximum extent permitted by law, the Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will meet your requirements or that results obtained will be accurate or reliable.
To the maximum extent permitted by law, eConnection will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill. Our total aggregate liability arising out of or relating to the Service or these Terms will not exceed the amount you paid to us for the Service in the twelve (12) months preceding the event giving rise to the claim (or USD 19 if you use the Free Plan). Nothing in these Terms excludes liability that cannot be excluded under applicable law.
You agree to indemnify and hold harmless eConnection from claims, damages and expenses arising from your Customer Data, your use of the Service, or your breach of these Terms or of applicable law (including data-protection and anti-spam law).
These Terms are governed by the laws of Malaysia. Subject to any mandatory rights you may have under the law of your country of residence, the courts of Malaysia will have exclusive jurisdiction over any dispute arising out of or in connection with these Terms, and you and we submit to that jurisdiction. We may first seek to resolve disputes informally — please contact us before commencing proceedings.
We may update these Terms from time to time. If we make material changes, we will provide reasonable notice (for example by email or in-app). Your continued use of the Service after the changes take effect constitutes acceptance of the updated Terms.
